The criminalization of serious human rights violations passed important stages in human history, the most prominent of which was in the twentieth century, especially after the Nuremberg 1945 and Tokyo 1946 trials, through the 1993 ex-Yugoslavia trials and the 1994 Rwanda trials, ending with the establishment of the statute of the permanent International Criminal Court 1998, where the cornerstone was laid for the beginnings. International criminal law to prosecute persons who commit crimes at the level of classification adopted at the present time, represented in the crime of genocide, crimes against humanity, and war crimes, defining the meaning and elements of these crimes, which can be described as standard crimes have specific determinants developed through the jurisprudence of criminal courts International, regardless of its difference with what was stipulated in international conventions and norms, settles on the basis of criminal legitimacy that international criminal law cannot deviate from, even if it is characterized by specific flexibility from that prevailing in national laws. Unfortunately, however, these crimes were not the only ones that are characterized by brutality and danger to the human being and society as a whole, but accompanied at all times by a crime that occupied the attention of the international community, which is the ethnic cleansing that was highlighted in the beginning of the nineties of the twentieth century and which was the focus of an important problem in international criminal law that it did not include In an explicit, written, or customary form. This opened the way for its adaptation to the three standard international crimes, which sparked a debate between agree and reject.
