The Iraqi legislator tried to find mechanisms to help commercial enterprises when they occur in case of default. The Bankruptcy and Reparation System in Iraqi Law and 50 years after the actual date of its formulation no longer suits the great economic, commercial and legal developments in this field. However, This system is no longer a refuge for traders in the event of default and can not achieve the desired benefits, but it remains only legal texts abandoned as a result of the failure of the developments that took place.
