The patent is one of the most important indicators of technological and scientific advancement, and it is among the industrial rights of intellectual property. The more developed societies are, the more innovations and inventions there are, and the number of inventors in them increases. Therefore, it was necessary to push the innovators and encourage them to further progress and creativity in this field.
Therefore It was the duty of the legislator to protect creators and inventors, so legal protection was granted for the patent, so that no person could be exposed to this invention unjustly, and that Iraq is one of the countries that paid great attention to this aspect through the enactment of internal legislation that protects the rights of intellectual property owners, including the right to patent, and has joined many international conventions and treaties.
It is worth noting that even before Iraq joined international conventions, intellectual property, including industrial property, was regulated and protected by the Iraqi legislature. Through this research, we would like to shed light on patent protection before and after the amendment of the law. In Iraq and the Kurdistan Region, and the weaknesses in it compared to some comparative laws.
