The international responsibility of unrecognized entities for human rights violations

Unrecognized entities exercise control over their territories and inhabitants through their institutions and organizational structures similar to the organizational structures of states, and that human rights violations are likely to occur in their territories and within their jurisdiction the same as states, and therefore the question arises regarding the possibility of holding these entities international responsibility for actions Or the omissions that are a violation of human rights and which are attributed to its affiliated agencies.
And since it is possible to impose certain obligations on unrecognized entities, especially under customary international human rights law, as international human rights law has developed and is increasingly considered that non-state actors may be bound in certain circumstances by international human rights law, especially When it exercises a certain degree of control over a territory and its inhabitants,
Consequently, these entities can be held internationally responsible for violations of these obligations. Since it is recognized that these entities bear the minimum of human rights obligations, it is therefore important to research the possibility of holding them internationally responsible in the event of a violation of these obligations by referring to the general rules for the emergence of international responsibility and invoking them, and to indicate the extent of their application to these entities other than Recognized.

- The Academic Journal of Nawroz University reserves all rights to publish research papers/articles issued under a “Creative Commons License (CC BY-NC-ND 4.0) which permits unrestricted use, distribution, and reproduction of the paper/article by any means, provided that the original work is correctly cited.
- Reservation of Rights
The researcher(s) preserves all intellectual property rights (except for the one transferred to the publisher under this Agreement).
- Researcher’s guarantee
The researcher(s) hereby guarantees that the content of the paper/article is original. It has been submitted only to the Academic Journal of Nawroz University and has not been previously published by any other party.
