Voting from abroad between grants and bans A comparative study in the light of contemporary electoral legislation

The number of citizens residing outside the borders of their countries in 2020 has exceeded 221 million, and this number is constantly increasing, and there are many reasons for it, including economic, political, social and other reasons. In light of the development of the concepts of democracy and human rights in the world, many international conventions and constitutions of countries emphasized the guarantee of human rights, and one of these rights is the political rights of citizens, the most prominent of which is the right to participate in elections and cast their votes, so it requests the constitutions of countries and election laws to regulate this right in a manner commensurate with the philosophy of granting it.
The participation of citizens who live within the borders of the country in the elections is indisputable, but as for citizens who reside outside the borders of the country in the elections that take place in their countries, it is a matter of discussion, and many questions have been raised in this regard, including, does every citizen who lives outside his country have the right to vote? Participate in voting in the elections held in his country? Does a citizen who lives far from his country have the right to influence the fateful decisions that are taken in his country and are affected by citizens inside the country?
In this research, after we knew voting from abroad and its historical development and mentioned the methods and types of voting from abroad, we looked at the trends followed by the constitutions of countries and the electoral laws to organize voting from abroad, which were divided into two directions, the first of which prevents a citizen who resides abroad from the right to vote, while The second gives this right, even if the conditions for regulating this right differ, and we presented the arguments of each direction, then we reached a set of conclusions after analyzing them. We recommended a number of recommendations that we believe, if adopted, will have a better role in organizing voting from abroad.
