The Role of the Idea of a Job Solution in Solving the Problem of Conflict of Nationalities ((Analytical Study))

The issue of conflict of nationalities occupies great importance in modern laws, through an attempt to find appropriate solutions in resolving the problem of multinationality or its absence in response to new trends in accordance with the goal and purpose of the rule of attribution, away from traditional trends in this field, which has been subjected to much criticism. On this basis, the features of a new idea emerged in the context of the conflict of nationalities, which is the idea of a functional solution based on determining the law applicable to the problem of multiple nationalities and their absence, based on the idea of not adhering to the application of the nationality law of the judge before whom the dispute is brought, which was determined by the rule of national attribution when his nationality is among them. , or the actual nationality in cases where his nationality is not among the existing nationalities, but rather applying “the essence and spirit of the conflict rule.”
The study seeks to identify the most important applications on which the idea of a functional solution is based. It came out with a set of results, the most important of which is that the idea of a functional solution has a guiding role in resolving the problem of conflict of nationalities by leaving discretionary authority to the judge in resolving the problem of multiple nationalities or the absence thereof on the basis of preferring one of the competing nationalities that the person holds in light of the nature and purpose of the attribution rule, and not considering The problem of nationality conflict is considered an independent problem with one solution in all cases. Rather, it must be viewed as an independent, primary or secondary problem that must be solved when the original problem occurs. It is best to solve it based on the nature of the original problem itself, the purpose or goals, and the spirit behind it. Put it down.
