Abstract

In the scheme of furthering Information and telecommunication technology, keeping pace with the great development in their use for almost every room of life, Iraqi legislature had enacted the Law of electronic signature and electronic transactions no-(78) of 2012. It stipulated that the rules of this Law are applicable to electronic transactions performed by natural and juridical persons. This allows the formal and governmental institutions to do their transactions by electronic devices.

      Due to the lack of a specific law applicable to administrative proof, administrative justice always relies on the general rules of evidencing, in as much as they are applicable to the natural and surrounding conditions of the administrative lawsuit. The principle is the freedom of proof in the room of administrative lawsuit. Keeping in mind that the general principle is that the said law suit could be proven in almost every way of proof, including testimony and presumption, and that the electronic documents are of the same traits existent in normal means of evidencing, the administrative judge can rest on Electronic documents and both the cellular phones and electronic website, being newly emerging scientific reliable ways of proof, for the establishment of evidence in the administrative lawsuit.
