The impact of international jurisdiction in determining the law to be applied to international private relations "An analytical study"

It is well known that resolving cases of legal relations requires two specialties, one judicial and the other legislative, and these two competencies are clear and easy in the framework of internal legal relations so that individuals know that the state’s jurisdiction has a general jurisdiction in the eyes of all individuals ’internal disputes and that its law is the reference in resolving these disputes, As for international private relations, we are usually faced with conflicts in the legislative and judicial jurisdiction. In principle, the rules of international jurisdiction of national courts differ from the rules of legislative jurisdiction. At the time when the rules of legislative jurisdiction are double-sided, they refer to the judge’s law and foreign law in a manner Neutrality and do not prefer national law over foreign law unless it is more appropriate and fairer in the ruling of the relationship according to theories of conflict of laws. However, merely holding the jurisdiction of the courts of a particular country brings in several cases the legislative competence of the law of the court, which affects the neutral balance between the judge’s law and foreign laws. Despite the statutory and inconsistent ratio of legislative jurisdiction to the court’s law, as in the case procedures, we find that the judicial jurisdiction brings the legislative competence in Several stages and cases within the attribution rules approach, as in the jurisdiction of the court law in adapting relationships and its competence when referring to the judge’s law, as well as in cases in which the applicable law cannot be reached or cannot be proven.

- Reservation of Rights
The researcher(s) preserves all intellectual property rights (except for the one transferred to the publisher under this Agreement).
- Researcher’s guarantee
